The Ministry of Agriculture says the registered holy basil variety "Kaew Chuli 01-04" only protects that new registered variety. Ordinary or native holy basil can still be grown, harvested, sold as leaves, or used in cooked food without liability. Selling seeds, seedlings or cuttings of the protected variety needs permission from the rights holder. The Plant Variety Protection Act (B.E. 2542) is being revised, and the public can submit comments. Questions go to the Plant Variety Protection group, Department of Agriculture, tel. 0-2940-7214.
